Terms of Service
1. Who we are
North Harbor Digital ("we", "us") provides website design, hosting, and social media management services to small businesses. By using our website or services you agree to these Terms.
2. Services we offer
- Website design — $799 one-time. Includes a custom-built, mobile-responsive website with basic SEO and a contact form.
- Professional hosting — $299/month. SSL, daily backups, uptime monitoring, and real-person support.
- Social media management — from $149/month. Four posts per month across selected platforms with engagement monitoring during business hours.
Detailed deliverables for each engagement are described in your individual order or statement of work.
3. Payment
Website design is invoiced 50% at project start and 50% at launch. Hosting and social media are billed monthly in advance. Annual plans are billed once per year and offer a 10% discount.
Invoices are due within 14 days. Late payments may result in service suspension.
4. Cancellation
Hosting and social media plans can be cancelled at any time. We do not charge cancellation fees and we do not bind you to long-term contracts. Cancellations take effect at the end of the current billing period; we do not refund partial months.
Website design projects can be cancelled before launch; you will be billed for work completed to date.
5. Your content and accounts
You retain ownership of all content you provide (copy, images, logos). You grant us a license to use that content to deliver our services. You are responsible for ensuring you have the rights to anything you give us.
For social media management, you grant us access to your accounts only for the purpose of posting and engaging on your behalf. You can revoke access at any time.
6. Acceptable use
You agree not to use our services for anything illegal, fraudulent, or that infringes on others' rights. We reserve the right to refuse or terminate service for any reason, including content we believe is harmful or unlawful.
7. Warranties and liability
We do our best work, but we provide services "as is" without warranties of any kind. To the maximum extent allowed by law, our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
8. Third-party services
We use third-party services (hosting providers, email tools, social platforms). We are not responsible for outages or changes those providers make. We will communicate any material impact to your service as soon as we know.
9. Changes to these Terms
We may update these Terms from time to time. We will notify active clients of material changes by email at least 30 days before they take effect.
10. Governing law
These Terms are governed by the laws of the State of New York. Any disputes will be resolved in the courts of Nassau County, New York.
